1. What DIGS Studio Provides

DIGS Studio is a digital media platform that transforms still images into cinematic visual content for real estate and property marketing.

DIGS Studio uses automated, algorithmic, and artificial-intelligence-based systems to enhance, animate, and render images into finished visual media.

DIGS Studio provides technology only. We do not provide marketing strategy, brokerage services, MLS compliance, legal advice, or advertising approval.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use DIGS Studio.

If you are using DIGS Studio on behalf of a company, brokerage, or other organization, you represent that you are authorized to bind that entity.

3. User Sessions & Order Records

DIGS Studio does not require permanent user accounts. You provide contact information such as name and email to submit content, receive deliverables, and complete payment.

Orders and files may be associated with your email for delivery, support, and record-keeping.

DIGS Studio does not guarantee long-term storage. Uploaded images and generated media may be deleted after delivery or a reasonable support period.

You are responsible for downloading and saving your files.

4. Accepted Content

DIGS Studio accepts image files only for processing (such as JPG, JPEG, PNG, or similar still-image formats).

You may not upload:

• Video files
• Audio files
• Documents or PDFs
• Contracts or legal paperwork
• MLS forms
• Personal identification
• Client records
• Any unlawful, private, or sensitive material

Any non-image or prohibited files may be deleted without notice.

5. User Content Rights

By uploading images, logos, or visual assets ("User Content"), you grant DIGS Studio a non-exclusive, worldwide, royalty-free license to store, process, modify, animate, and render that content solely to produce the output you request.

You retain ownership of your User Content.

You represent and warrant that you own or have legal rights to all content you upload.

6. AI-Generated Output

DIGS Studio uses automated and artificial-intelligence-based systems to generate visual media.

You understand and agree that:

• Output may not be unique
• Output may contain errors, distortions, or artifacts
• Output may resemble content generated for other users
• DIGS Studio does not guarantee originality, copyright clearance, factual accuracy, MLS compliance, or suitability for advertising

DIGS Studio does not provide legal, advertising, MLS, brokerage, or compliance advice. You are solely responsible for determining whether any output is lawful, accurate, and suitable for public use.

Outputs are provided for marketing and illustrative purposes only.

7. Prohibited Use

You may not use DIGS Studio to:

• Violate any law or regulation
• Infringe copyrights or trademarks
• Misrepresent property or listings
• Upload unlawful, deceptive, or harmful material
• Reverse-engineer, scrape, or exploit the platform

We may refuse service, cancel orders, or block future use at our discretion.

8. Payments & Refunds

DIGS Studio charges a one-time fee per video or media render.

Payment is collected at the time an order is submitted. Processing begins immediately upon submission.

Because each order involves compute-intensive custom rendering, all sales are final once processing begins. No refunds, cancellations, or chargebacks are permitted after processing has started.

9. Service Availability & Third-Party Systems

DIGS Studio is provided "as-is" and "as-available."

We rely on third-party cloud providers, AI systems, and software platforms. We are not responsible for delays, errors, outages, failures, or service interruptions caused by these systems.

We do not guarantee uptime, speed, or error-free results.

10. Intellectual Property

All DIGS Studio software, branding, interfaces, and platform technology belong to DIGS Studio and may not be copied, resold, or exploited without permission.

11. Limitation of Liability

To the maximum extent permitted by law, DIGS Studio is not liable for:

• Lost commissions
• MLS or broker disputes
• Copyright or licensing claims
• Advertising losses
• Client or seller disputes
• Business interruption

Our total liability shall not exceed the amount you paid to DIGS Studio in the prior 30 days.

12. Indemnification

You agree to defend, indemnify, and hold harmless DIGS Studio, its owners, employees, and contractors from any claims, damages, losses, or legal fees arising from:

• Content you upload
• How you use DIGS Studio output
• Any violation of these Terms or applicable law

13. Termination

We may suspend or terminate access at any time for violations of these Terms.

You may stop using DIGS Studio at any time.

14. Governing Law

These Terms are governed by the laws of the State of California. All disputes shall be resolved in California courts.
